IMPORTANT: Please read these Terms of Service carefully before using MyHRProof. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and MyHRProof, LLC ("MyHRProof," "we," "us," or "our") governing your access to and use of the MyHRProof mobile application, website at myhrproof.com, and all related services (collectively, the "Service").
Age Requirement — You must be 18 or older: MyHRProof is intended solely for adults in employment situations. By accessing or using the Service, you represent and warrant that you are at least 18 years of age. If you are under 18, you are not permitted to use MyHRProof and must exit immediately. We do not knowingly collect personal information from individuals under 18. If we discover a user is under 18, we will immediately terminate the account and permanently delete all associated data with no refund.
By accessing or using the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into this agreement, and agree to be bound by these Terms and our Privacy Policy.
2. Description of Service
MyHRProof is a workplace documentation and education platform that enables users to:
- Log and organize workplace incident records with timestamps, photos, and voice memos
- Access educational content about employment rights and labor laws
- Upload employee handbooks for AI-assisted policy analysis
- Export formatted documentation reports
- Access mental health and self-advocacy resources
MyHRProof is not a law firm and does not provide legal advice. No attorney-client relationship is created by use of this Service. The Service is for informational and documentation purposes only.
3. User Accounts
3.1 Registration
You must create an account to use most features of the Service. You agree to provide accurate, complete, and current information and to keep your account information up to date.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@myhrproof.com if you believe your account has been compromised. You are responsible for all activity that occurs under your account.
3.3 One Account Per User
You may only maintain one MyHRProof account. Creating multiple accounts to circumvent subscription limits or restrictions is prohibited.
4. Subscriptions and Payment
4.1 Introductory Offer
New subscribers may be offered a reduced first-month price of $1.99 before the subscription converts to the standard monthly rate ($9.99–$29.99/mo depending on plan). The introductory charge is non-refundable. For subscriptions purchased through the Apple App Store, the introductory offer is subject to Apple’s terms and is charged to your Apple ID at the time of purchase. Your subscription will automatically renew at the standard price unless cancelled at least 24 hours before the renewal date.
4.2 Subscription Terms
Paid subscriptions are billed monthly in advance. Subscriptions automatically renew unless cancelled before the renewal date. We will notify you by email before any price changes take effect.
4.3 Payment Processing
In-app purchases are processed by Apple through the App Store. Your subscription entitlements are managed on our behalf by RevenueCat, Inc. We do not receive or store your payment card details. Your subscription automatically renews for the same period unless you turn off auto-renewal at least 24 hours before the end of the current period; your Apple ID is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription at any time in your Apple ID account settings (Settings → your name → Subscriptions). Deleting the app does not cancel a subscription.
4.4 Taxes
Prices displayed are exclusive of applicable taxes. You are responsible for all taxes applicable to your subscription based on your location.
4.5 Refunds
Because purchases are made through the Apple App Store, refunds are handled by Apple under Apple’s policies. To request a refund, use Apple’s process at reportaproblem.apple.com. We are generally unable to issue refunds directly for App Store purchases.
5. Acceptable Use
You agree to use MyHRProof only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service to harass, threaten, or defame any person
- Upload or transmit any unlawfully obtained content
- Attempt to reverse engineer, decompile, or hack the Service
- Use automated tools to scrape or extract data from the Service
- Impersonate any person or entity
- Use the Service to engage in any illegal activity
- Share your account credentials with others
- Circumvent any security or access control measures
- Upload content that infringes on third-party intellectual property rights
6. User Content
You retain full ownership of all content you create, upload, or store in MyHRProof ("User Content"). By uploading User Content, you grant MyHRProof a limited, non-exclusive license to process and store your content solely for the purpose of providing the Service to you.
You represent and warrant that your User Content does not violate any third-party rights, applicable law, or these Terms. MyHRProof does not review User Content for legal compliance, and we are not responsible for the accuracy or legality of your records.
7. Intellectual Property
The MyHRProof name, logo, application, website, and all content created by MyHRProof (excluding User Content) are owned by MyHRProof, LLC and protected by U.S. and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.
8. No Legal Advice; Information Only
MyHRProof is a self-help documentation and educational tool. It is not a law firm, and no attorney-client relationship is created by your use of the Service.
Nothing provided through the Service constitutes legal advice, and none of it may be relied upon or construed as legal advice or as a substitute for consultation with a licensed attorney. This includes, without limitation, all information, summaries, law updates, notifications, deadlines, wage or salary estimates, educational content, and any response generated by the “Charlie” assistant or any other automated or AI system — as well as any statement, recommendation, suggestion, opinion, or interpretation made by MyHRProof, its owners, officers, employees, contractors, agents, or representatives.
Law updates and legal summaries are provided for general informational purposes only. They may be incomplete, out of date, or inaccurate; they may be generated by automated systems; and they may not reflect the current law in your jurisdiction or apply to your specific situation. You are responsible for reading and verifying the actual law yourself and for consulting a licensed employment attorney before taking or refraining from any action. These updates are intended only to make you aware that laws affecting workers may have changed — not to tell you what to do about them.
To the maximum extent permitted by applicable law, you agree to hold harmless and release MyHRProof, LLC and its owners, officers, employees, contractors, and agents from any loss, damage, claim, or liability arising out of or relating to your reliance on any information, summary, update, estimate, or AI- or human-generated response obtained through the Service, including any error, omission, inaccuracy, misinformation, or content that you interpret or misconstrue as legal advice. You use all such information at your own risk.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF INFORMATION. MYHRPROOF DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT INFORMATION PROVIDED WILL BE LEGALLY ACCURATE OR CURRENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYHRPROOF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF A LEGAL CLAIM, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO MYHRPROOF IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless MyHRProof, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
12. Termination
You may cancel your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We will provide you with an export of your data upon request made within 30 days of termination.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the United States of America, without regard to conflict of law principles. Until such time as MyHRProof, LLC is formally organized in a specific U.S. state, disputes shall be resolved in the federal or state courts of competent jurisdiction in the United States. Any dispute arising under these Terms shall be resolved by binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property violations. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email and by posting a notice in the app at least 30 days before changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
