Digital Millennium Copyright Act Notice and Takedown Policy  ·  Effective: January 1, 2025

Overview

MyHRProof, LLC ("MyHRProof") respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe that content on our platform infringes your copyright, you may submit a DMCA takedown notice as described below.

Filing a DMCA Takedown Notice

To submit a valid DMCA takedown notice, your written communication must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works)
  3. Identification of the specific content you claim is infringing and its location on our platform (URL or sufficient description to locate it)
  4. Your contact information: full legal name, mailing address, telephone number, and email address
  5. A statement that you have a good faith belief that the use of the content is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

Counter-Notice

If you believe your content was removed by mistake or misidentification, you may submit a counter-notice. To be effective, your counter-notice must include:

  1. Your physical or electronic signature
  2. Identification of the content that was removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief that the content was removed as a result of mistake or misidentification
  4. Your name, address, telephone number, and email address
  5. A statement that you consent to the jurisdiction of the federal district court in your district (or a court of competent jurisdiction in the United States if outside the U.S.) and that you will accept service of process from the original complainant

Our Response

Upon receipt of a valid DMCA notice, we will:

If a valid counter-notice is received and no legal action is filed within 10 business days, we may restore the removed content.

Repeat Infringer Policy

MyHRProof will terminate the accounts of users who are found to be repeat infringers of copyright, consistent with our Terms of Service and the requirements of 17 U.S.C. § 512(i).

Misrepresentation Warning

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that content is infringing, or that content was removed by mistake, may be subject to liability for damages. Do not file a notice if you are not certain the content infringes your copyright.

User-created incident records within MyHRProof are private and encrypted, and are not publicly accessible. If you have concerns about data other than publicly accessible content, please contact us at privacy@myhrproof.com.
